The word comes from the Semitic root sh-r-ṭ, whose base verb شَرَطَ means to cut or make an incision. From scoring or marking a surface the sense moved to setting down a stipulation, a term fixed in advance. Classical legal language then settled on شَرْط for a condition that binds a contract or an act.
